The artificial person called “Saporis Comercial”, a variable capital corporation (hereinafter the “Responsible Party”), domiciled in Oriente Cuatro #602, Colonia Ciudad Industrial, código postal 58200, Morelia, Michoacán.

 

Puts at your disposal the following Privacy Notice that is detailed below, in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the "Law") and in accordance with its Regulations (hereinafter "The Regulation").

 

1.- TREATMENT AND PURPOSE OF THE PERSONAL DATA OF THE HOLDER

 

The Responsible Party deals with contractors, customers, suppliers or providers of goods and / or services, all of them natural and artificial persons (hereinafter "The Holder"), the following categories of personal data: Identification or personality data (such as: The name, company name, age, nationality, gender, etc.,), fixed assets or financial data, labor and academic data, home address, billing information, credit and / or debit card numbers and / or promotional numbers, telephones, email, special requirements, corporate data, legal representation data, official identification, security video recordings, company or business line, among others.

 

The personal data mentioned above can be obtained (i)personally through the holder; (ii) directly, either electronically, through requests, questionnaires or formats or (iii) indirectly through public access sources or third parties authorized by the Responsible Party. This data is collected and generated from the legal relationship with the title.

 

The personal data that the Responsible Party deals with, is obtained for the two purposes indicated below:

 

1.- Those which origin a legal relationship between the Responsible Party and The Holder, and are necessary for the existence, maintenance and compliance of the legal relationship:

a). - In case of customers, the provision of commercial services, deposit, or other provision of services related to the legal relationships indicated above;

 

b) In case of suppliers or suppliers of goods and / or services, for the fulfillment of the obligations derived from the provision of the service settled between the Holder and the Responsible Party, which are established in the civil or commercial contracts, respectively;

 

c). - Identifying the Holder when requesting goods and services from the Responsible Party; and

 

d). - In general for all purposes related to the contractual legal relationship or any other nature that has been held between the Responsible Party and the Holder (such as, billing information, charges to credit cards and / or debit cards for the provision of a service by the Responsible Party, evaluation, and quality and satisfaction of goods and services surveys, etc.).

 

2.- Non-necessary purposes nor that give rise to a legal relationship with the Responsible Party, such as: Advertising of goods, promotions or services related to the Responsible Party, evaluation of documents to access credits or related services.

 

2. DATA TRANSFER

 

The Responsible Party agrees not to transfer your personal information to third parties, whether natural or artificial persons, without your consent, except:

 

a). - In case of Mexican or foreign persons who are subsidiaries, affiliates or dependents of the Responsible Party, since the transfer of data is essential for it to be maintained, and the legal relationships listed in point I (one Roman numeral) of the section called TREATMENT AND PURPOSE OF THE PERSONAL DATA OF THE HOLDER.

 

b). - The exceptions provided in Article 37 of the Federal Law on Protection of Personal Data in Possession of Individuals, as well as to make this transfer in the terms established by the stated Law

 

c). - Judicial authorities, Mexican and foreign, in order to comply with notifications, requirements or offices of a judicial or extrajudicial nature; and

 

d). - In case of any transfer of the personal data of the Holder that requires your express consent, you will be requested.

 

In a special way we inform you that "The Responsible Party" shares your personal information with the following companies: CREDIX GS, SA DE CV, SOFOM, ENR and TAMOGI SAPI DE CV, SOFOM, ENR, with the purpose of offering you financing options. In relation to the transfer of information indicated above and that requires your consent; we inform you that if you have not indicated your refusal for this transfer to occur, we will understand that you have given us your consent. You can object to the transfer of your information indicated in this section by following the procedure for revocation of consent established in this notice.

 

3.- MEANS FOR THE EXERCISE OF THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION (COMMONLY KNOWN AS "ARCO" RIGHTS).

 

 

The Holder has the right to access their personal data held by the Responsible Party, as well as to correct them if they are inaccurate or incomplete; cancel them when he considers that they are not required for any of the purposes indicated in this Privacy Notice as well as when they are being used for non-consensual purposes or the contractual or service relationship has ended, or oppose their treatment for specific purposes (hereinafter, the "ARCO Rights").

 

The mechanisms implemented for the exercise of "ARCO Rights" are exercised through the presentation of the particular application at the address of the Responsible Party located in Oriente Cuatro # 602, Colonia Ciudad Industrial, C.P. 58200 Morelia, Michoacán.

Response time: Within a maximum period to receive a response to the Holder's request, it is 20 (twenty) business days, counted from the day on which it was received, so that, if it is appropriate, make it effective within fifteen days following the date on which the response is communicated.

 

In case of requests for access to personal data, the delivery shall proceed after proof of identity that the applicant is the Holder or legal representative with full powers, as appropriate.

 

The aforementioned deadlines may be extended by the Responsible Party once for an equal period, provided that the circumstances of the case justify it.

 

The exercise of the ARCO Rights is free, and the Holder should only cover, as the case may be, the costs for reproducing or sending documents.

 

To know the mechanisms implemented for the exercise of the ARCO Rights, the Holder must contact the Responsible Party through the Personal Data Security Area located at: Oriente Cuatro # 602, Colonia Ciudad Industrial, C.P. 58200 Morelia, Michoacán; or, by email to proteccion.datos@saporis.mx or call (443) 323 23 00.

 

The Holder also has the right to initiate a Data Protection Procedure before the Federal Institute of Access to Information and Data Protection itself, which can be consulted at www.ifai.gob.mx. The Protection Application is found at: http://inicio.ifai.org.mx/DocumentosdeInteres/SolicitudDeProtecciondeDerechos.pdf, within 15 (fifteen) business days following the date on which you receive the response or as of the end of the term of 20 (twenty) business days from the date of receipt of your application for the exercise of ARCO Rights or, as the case may be, at the end of the respective extension period.

 

4.- MECHANISMS AND PROCEDURES FOR THE REVOCATION OF CONSENT

 

At any time the Holder may revoke the consent granted to the Responsible Party for the treatment of their personal data, in order for the Responsible Party to stop using and treating them.

 

The procedure for revocation is the same as that mentioned for the exercise of the ARCO Rights, through the request, with the requirements, response times and means to respond, mentioned in the previous numeral.

 

5.- CHANGES TO THE PRIVACY NOTICE

 

The Responsible Party reserves the right to make modifications or updates to this Privacy Notice at any time, for the attention of new legislation, internal policies of the company or new requirements for the provision or offering of its contracting services.

 

The aforementioned modifications will be announced to the Holder through visible advertisements at the address of the Responsible Party located at Oriente Cuatro # 602, Colonia Ciudad Industrial, C.P. 58200 Morelia, Michoacán, or on the website http://saporis.mx, It is suggested that you visit the site frequently.
